Welcome to SleepGuard!

These Terms of Service ("Terms") govern your use of the SleepGuard bedtime enforcement app available on iPhone and Mac (the "App"), and our website at https://sleepguard.top (the "Website"). By downloading, installing, or using SleepGuard, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use SleepGuard.

1. Description of Service

SleepGuard is a bedtime enforcement application that helps users build consistent sleep habits by:

- Blocking access to distracting apps and websites at designated bedtimes
- Tracking sleep streaks and consistency
- Calculating sleep scores and sleep debt
- Integrating with Apple Health to monitor sleep data
- Providing accountability features through partner sharing (Premium)
- Enforcing bedtime schedules with system-level blocking

SleepGuard is available on:
- iPhone (iOS 17 or later)
- Mac (macOS Sonoma or later)

2. Account Registration

To use SleepGuard, you must:

- Be at least 13 years of age (or the legal age of majority in your jurisdiction)
- Provide accurate and complete registration information (name, email)
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account

You are responsible for all activities that occur under your account.

3. Subscription Plans and Pricing

3.1 Free Plan

The Free plan includes:
- Bedtime blocking
- Streak tracking
- Sleep score calculation
- Dashboard access
- Emergency pass (1 per month)
- Apple Health sync

3.2 Lifetime Premium ($4.99 one-time payment)

The Lifetime Premium plan includes everything in Free, plus:
- Partner sharing for accountability
- Consequence mode (blocks apps the day after breaking a streak)
- Adaptive bedtime (automatically adjusts based on sleep debt)
- HomeKit integration (trigger scenes at bedtime)
- Wind-down audio (gradually fades audio before bedtime)
- Advanced insights and analytics

Premium is a one-time purchase with lifetime access. No recurring subscription fees.

4. Payment and Billing

- Payments are processed securely through Stripe
- All prices are in USD unless otherwise stated
- The Lifetime Premium purchase is a one-time payment
- You authorize us to charge your payment method for the amount due

5. Refund Policy

We offer a 7-day money-back guarantee for Lifetime Premium purchases:

- Request a refund within 7 days of purchase
- Contact us at bartzalewskidev@gmail.com with your purchase details
- Refunds are issued to the original payment method within 5-10 business days
- After 7 days, all sales are final

Refunds are not available if:
- Your account has been terminated for violating these Terms
- You have been found to abuse the refund policy

6. App Functionality and Blocking

6.1 How Blocking Works

- SleepGuard blocks apps and websites you select during your designated bedtime
- Blocking is enforced at the system level and cannot be easily bypassed
- Essential functions (phone calls, messages, alarms) continue to work
- You receive a 5-minute warning before blocking begins

6.2 Emergency Pass

- Free and Premium users receive 1 emergency pass per month
- Emergency pass temporarily disables blocking for legitimate emergencies
- Using an emergency pass requires Face ID/Touch ID authentication
- Emergency pass usage is logged and cannot be undone
- Frequent emergency pass use may affect your streak

6.3 Limitations

While SleepGuard uses advanced blocking techniques:
- We cannot guarantee 100% blocking in all scenarios
- Technical limitations may exist on certain devices or OS versions
- Determined users may find workarounds (though we actively patch these)
- SleepGuard is a tool to help you build habits, not a prison

7. Apple Health Integration

- SleepGuard requests permission to access your Apple Health sleep data
- You can revoke this permission at any time through iOS Settings
- Health data is used solely to calculate sleep scores and track progress
- We do not share your health data with third parties
- Your health data remains on your device and in your iCloud account

8. Partner Accountability (Premium Feature)

When you connect with an accountability partner:

- Both parties must consent to the connection
- Only streak data is shared between partners
- Sleep data and health information remain private
- Either party can disconnect at any time
- You are responsible for choosing trustworthy partners
- We are not liable for disputes between partners

9. User Conduct

You agree NOT to:

- Attempt to bypass, disable, or circumvent SleepGuard's blocking mechanisms
- Share workarounds or exploits that defeat the purpose of the app
- Use the app for any illegal or unauthorized purpose
- Reverse engineer, decompile, or disassemble the app
- Use automated systems or bots to interact with SleepGuard
- Harass, abuse, or harm other users (including accountability partners)
- Sell, transfer, or share your account with others
- Create multiple accounts to abuse the refund policy

Violation of these terms may result in account suspension or termination without refund.

10. Intellectual Property

- SleepGuard, its logo, and all related marks are our property
- The app design, features, and code are protected by copyright
- You may not copy, modify, or create derivative works
- You receive a limited, non-exclusive, non-transferable license to use the app
- This license terminates if you violate these Terms

11. Data Privacy

Your use of SleepGuard is also governed by our Privacy Policy at https://sleepguard.top/privacy-policy, which is incorporated into these Terms by reference. Please review it carefully to understand how we collect, use, and protect your data.

12. Disclaimers and Limitations of Liability

12.1 No Medical Advice

- SleepGuard is a productivity and habit-building tool, not a medical device
- We do not provide medical advice, diagnosis, or treatment
- Sleep scores and insights are for informational purposes only
- Consult a healthcare provider for medical concerns about sleep

12.2 "As Is" Disclaimer

SleepGuard is provided "as is" without warranties of any kind, express or implied, including but not limited to:

- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Uninterrupted or error-free operation
- Accuracy or reliability of results

12.3 Limitation of Liability

To the fullest extent permitted by law:

- We are not liable for any indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the amount you paid for Lifetime Premium ($4.99)
- We are not responsible for lost sleep, productivity, or relationships
- We are not liable for device issues, data loss, or health problems

13. Indemnification

You agree to indemnify and hold harmless SleepGuard and its creators from any claims, damages, or expenses arising from:

- Your use of the app
- Your violation of these Terms
- Your violation of any third-party rights
- Your interactions with accountability partners

14. Termination

We may suspend or terminate your account if you:

- Violate these Terms
- Engage in fraudulent activity
- Abuse the refund policy
- Harass other users
- Attempt to reverse engineer or exploit the app

You may terminate your account at any time by:

- Deleting your account through the app settings
- Contacting us at bartzalewskidev@gmail.com

Upon termination:
- Your access to Premium features ends immediately
- Your data will be deleted within 30 days
- No refunds are issued except during the 7-day guarantee period

15. Changes to Terms

We may update these Terms from time to time. Changes will be communicated via:

- Email to your registered address
- In-app notification
- Updated "Last Updated" date at the top

Significant changes will take effect 30 days after notification. Continued use after changes constitutes acceptance.

16. Dispute Resolution

16.1 Informal Resolution

Before filing a legal claim, please contact us at bartzalewskidev@gmail.com to resolve the issue informally. Most disputes can be resolved quickly and amicably.

16.2 Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

16.3 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration, not in court, except where prohibited by law.

17. Miscellaneous

17.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and SleepGuard.

17.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.

17.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

17.4 Assignment

You may not assign or transfer these Terms. We may assign them without restriction.
